Any goods ordered and delivered remain property of ASSOS USA LLC until full payment of all amounts due, under the Agreement relating to client. Should for any reason come to a delay in payment, we will charge five percent (5%) interest until receipt of the payment in full.

Important: Notwithstanding all precautions, packages and/or their contents sometimes get damaged in transit. If this should happen, please follow the following procedure: breakages should initially be announced and registered with the courier, at once upon receipt of the goods. You should then inform us immediately thereafter. If you intend to return damaged goods, please inform us in advance via customer care using our CONTACT US form

The products offered are posted on the Internet site as clearly as possible. We have attempted to portray the colours of our products in a realistic manner, however we cannot guarantee that the colours as seen on your computer match those of the real products, due to the individual nature of your screen graphics or printer.

Client data will be collected and used by ASSOS USA LLC only for the analysis, approval and execution of the Agreement and for the care and management of the relative relationship with the client, the recovery of outstanding payments and fight against fraud and abuse. Data obtained by ASSOS USA LLC may be used for marketing purposes (for example, Newsletters), if the client has no objection.
Your personal data may be used as mentioned above only by ASSOS USA LLC. However, in order to execute your order, we will have to give your personal data to other companies, such as our couriers responsible for logistics and our financial services partners for credit card transactions. Certificate of Compliance for PFAS Regulations in Textile Articles Pursuant to California Assembly Bill 1817, New York Environmental Conservation Law (ECL) 37-0121, Maine's PFAS in Products Law 2021

Purpose Statement

This document certifies that the textile articles directly distributed by Assos of Switzerland in the states of California, New York and Maine, comply with the PFAS regulations applicable in these states:

• California Assembly Bill 1817 (effective January 1, 2025)
• New York Environmental Conservation Law (ECL) 37-0121
• Maine's PFAS in Products Law 2021

These regulations prohibit or restrict the use of per- and polyfluoroalkyl substances (PFAS) in textile products.

Terminology

• Textile Articles: Includes any goods made from natural, man-made, or synthetic fibers, such as apparel, accessories, and home furnishings (e.g., towels, bedding, upholstery).
• PFAS regulations: Defined any intentionally added PFAS with functional or technical effects
• Exemptions: Includes personal protective equipment (PPE) and outdoor apparel for severe wet conditions, subject to disclosure requirements.

Compliance Statement

Assos of Switzerland certifies that the textile articles distributed for sale in California, New York, and Maine are PFAS-free, in compliance with applicable state regulations.

Where Water Repellent chemical treatment have been intentionally added, they are PFAS free in compliance by law.

Any garments currently containing PFAS are listed in the attached addendum: "Made with PFAS chemicals" These garments will not be distributed directly by Assos of Switzerland and the Company will share this documents with any current and future Customer to advice about the restricted garments

If a product falls under an exemption (e.g., outdoor apparel for severe wet conditions), it will be labeled accordingly:

You agree that the sole jurisdiction and venue for all controversies deriving from the business relationship between the client and ASSOS USA LLC (including use of or order placed on www.assosoutlet.com/us) shall be an appropriate federal or state court located in Salt Lake City, Utah USA, the US headquarters of ASSOS USA LLC.

16.2 Severance Clause
In the case in which a clause of these Conditions Of Sale were to be null or should become so in the future, the validity of all other Conditions or Agreements will not be affected.

Gift Card Terms
- ASSOS gift cards can be redeemed to purchase ASSOS products online only, at www.assosoutlet.com/us
- Each card can be redeemed in part, with the remaining balance credited to your ASSOS account.
- Must be redeemed within five (5) years of purchase and must be used in the same currency as they’re purchased.
- If the order value is greater than the value of the gift card, the difference must be paid by credit/debit card, or using PayPal.
- Gift cards are non refundable but can be combined with other offers and other gift cards.

THE CHALLENGE

Outride Winter is for Strava members who complete 200km or recorded activity within the challenge period of 2 weeks. A minimum 15 minutes per activity is required to be eligible. All finishers of the Challenge are given the opportunity to redeem a 15% discount coupon code on https://www.assos.com/us and https://www.assos.com/us_es or on ASSOS product in independent bike dealers in North America by entering in their email address and opting in to accept ASSOS’ Privacy Policy and Terms and Conditions as well as opting in to receive marketing communications from ASSOS. Redemption of the reward by finishers automatically enters them into the Competition.

THE COMPETITIONS

The competition to win one of six complete winter ASSOS outfits (3 men and 3 women outfits available) is for Outride Winter challenge athletes who complete the challenge on the Strava platform over the course of the Challenge period. The 6 winners are chosen at random from the entire database of athletes who complete the challenge and enter their details on ASSOS.com.

TERMS & CONDITIONS

By entering the Challenge, all entrants will be deemed to have accepted and be bound by the terms and conditions and all entry instructions form part of these terms and conditions. These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

HOW TO ENTER:

Eligibility: The Challenge and Competition is open to Strava users aged 18 or over, excluding employees of the Promoter and their immediate families, its agents and anyone professionally connected with this Challenge and Competition. Entry: Entry to the Challenge is available upon use of Strava. The Challenge starts and ends based on each user’s local time zone. Manual entries, or rides marked ‘Private’ will not count towards your challenge effort. All activities logged during the Challenge period must be uploaded to Strava no later than three days after the challenge ends. In order to claim the 15% coupon code, challenge finishers must enter their email address into the reward form and accept the ASSOS Terms and Conditions and Privacy Policy. Subscribers can unsubscribe at any point thereafter and still receive/use their reward. By challenge finishers entering their email address, they will automatically be entered in the Prize draw(s). No purchase necessary.

Entry Period: Opens at 00.01hrs on Thursday 18^th November 2021 and closes at 23.59hrs on Wednesday 1^st December 2021. All entries must be made directly by the person entering the Challenge & Competition. Entrants who do not give correct details will be disqualified, at the Promoter’s discretion.

If any items purchased with the voucher are returned only the discounted price will be refunded or credited. The unique discount code can only be used once per person and cannot be used in conjunction with any other promotion or offer - including archive sale items. Third party collaborations items are excluded from discounts. Only one discount voucher can be redeemed per single transaction. The offer excludes the purchase of gift cards. Vouchers cannot be exchanged for cash. We reserve the right to withdraw, alter or decline this offer without prior notice. The reward Discount Voucher expires on 31^st December 2021.

Finishers Notification: Finishers will be notified by Strava upon completion of the Challenge period and directed to claim the prize(s) via email.

Prizes are non-transferable and cannot be resold, or exchanged for cash.

The Promoter reserves the right to publish the name, photograph, likeness and county of the Winner or to publicise the Competition or the prize-giving presentation, in any and all media that the Promoter desires, after the date of the Competition close date and within a year of this date.

The Winner agrees to take part in such reasonable Competition-related publicity as the Promoter may require and accepts that the Promoter may publicise images/statements in connection with/resulting from this Competition.

Prize: The winner of the ASSOS winter outfits, (3 men and 3 women outfits available) will be drawn at random on 10 December 2021 from all eligible entries.

The 15% discount coupon code or ASSOS outfits cannot be redeemed for cash. The prize(s) cannot be or transferred to another person without written consent from ASSOS. Any additional costs incurred in the process of claiming or delivering the prizes or the “winner” selecting additional products or services from ASSOS will be worn by the “winner”. The odds of winning depends on the amount of entries received. In order to enter the prize draw, the competitor must complete 200km of eligible activity within the two week challenge period and upload their activities to Strava.
